ข้อตกลง
— ข้อตกลงเบื้องต้น
❖ โปรดอ่านรายละเอียดราคา, เงื่อนไขและข้อตกลงให้ครบถ้วน เมื่อเริ่มงานจะถือว่าผู้ว่าจ้างได้ทำการอ่านและยอมรับข้อตกลงเรียบร้อยแล้ว
❖ ทางผู้วาดขออนุญาตนำผลงานเสร็จสมบูรณ์เก็บลง Portfolio เป็นตัวอย่างงานในอนาคต รวมถึงลงผลงานผ่านช่องทางโซเชียลมีเดียต่างๆ โดยมีการคาดลายน้ำในภาพและย่อขนาดของไฟล์ไว้ หากผู้ว่าจ้างไม่สะดวก สามารถแจ้งขอบเขตของการลงงานให้เราได้ค่ะ (หากมีการทำสัญญา NDA ในการเผยแพร่จะมีการคิดค่าใช้จ่ายเพิ่มตามแต่ตกลงกัน)
❖ ไม่จำเป็นต้องให้เครดิตผลงานเสมอไป แต่ขอความร่วมมือไม่แอบอ้างผลงาน สามารถให้เครดิตภายใต้ชื่อ ‘AspirinMarble' หรือ ช่องทางโซเซียลมีเดียของเรา (Facebook, Twitter )
❖ โปรดแจ้งเราก่อนทุกครั้งหากงานที่สั่งจะนำไปใช้ในเชิงพาณิชย์ (Commercial Use) ราคาเชิงพาณิชย์จะเป็นราคา x2 จากราคางานใช้ส่วนตัว (Personal Use)
—หมายเหตุ: ขอบเขตของการใช้งานเชิงพาณิชย์ คือการนำภาพไปใช้ทำสินค้าหรือต่อยอดเพื่อแสวงหากำไร ตัวอย่างเช่น ปกนิยาย, โปสการ์ด, ของที่ระลึก(พวงกุญแจ สแตนดี้ อื่นๆ), ภาพอาร์ตเวิร์คสำหรับการโฆษณา-ประกอบธุรกิจ, ภาพอาร์ตเวิร์คที่เกี่ยวข้องกับ vtuber หากไม่แน่ใจขอบเขตด้านการใช้งานสามารถทักมาสอบถามเพิ่มเติมผ่านข้อความ Facebook, Twitter และ Email ได้เสมอค่ะ
❖ ไม่อนุญาตให้นำภาพไปใช้กับ NFT หรือ AI Generator— สิทธิ์ภายในผลงานของผู้วาดและผู้ว่าจ้าง
❖ หลังจบการทำงานและส่งมอบไฟล์ ผู้ว่าจ้างมีสิทธิ์ในการแก้ไข/ปรับเปลี่ยนผลงานได้เพียงแค่การปรับโทนสี, ครอปตัด, ปรับขนาดผลงาน, นำภาพไปจัดเลย์เอาท์, ทำซ้ำไฟล์เท่านั้น
❖ หากมีการวาดทับ, แต่งเติมเส้นสี หรือใช้เครื่องมือในการปรับรูปทรงในผลงานเดิมจนเค้าโครงเปลี่ยน ขอความร่วมมือแจ้งและขออนุญาตผู้วาดก่อนทุกครั้ง เพื่อพิจารณาขอบเขตในการแก้ไขผลงานนั้น ๆ ห้ามเทรซ(Tracing)ผลงานโดยเด็ดขาด
❖ ในกรณีที่มีการส่งไฟล์ตัวละครพื้นใสแยกไว้ ทางเราอนุโลมให้ผู้ว่าจ้างสามารถเติมแต่งพื้นหลัง พร็อพประกอบเองได้โดยไม่กระทบกับตัวผลงานเดิมมาก
❖ ผู้วาดมีสิทธิ์ในการอัด Timelapses และเผยแพร่ WIP ของชิ้นงานโดยไม่แจ้งล่วงหน้า ผู้ว่าจ้างโปรดแจ้งความประสงค์ก่อนเริ่มงานหากไม่สะดวก
❖ เงื่อนไขอื่น ๆ สามารถเพิ่มเติมได้ตามแต่ตกลง
ขั้นตอนการจ้างงานและการทำงาน
— การจองและจัดลำดับคิว
❖ ลำดับขั้นตอนต่าง ๆ อาจจะมีการปรับเปลี่ยนตามเงื่อนไขของการเปิดคอมมิชชั่นแต่ละรอบ
❖ ผู้ว่าจ้างจองคิวผ่านทางแพลตฟอร์ม โดยเราจะเปิดรับคิวงานเป็นรอบ ๆ ตามช่วงเวลาที่กำหนด และติดต่อไปภายใน 48 ชม. หลังรับชื่อ
❖ 1 คิวสามารถสั่งได้สูงสุด 2 งาน
❖ จัดลำดับคิวตามลำดับการส่งบรีฟ จะเริ่มทำงานคิวถัดไปหลังจบงานของคิวก่อนเสร็จเรียบร้อย
❖ ระยะเวลาในการส่งบรีฟจะต้องไม่เกิน 1 อาทิตย์หลังการคอนเฟิร์มคิว (หรือปรับเปลี่ยนความสะดวกของผู้ว่าจ้าง)
❖ หากรายละเอียดบรีฟที่ได้มาเกินความสามารถของเรา เรามีความจำเป็นจะต้องปฏิเสธรับงาน แต่ยังสามารถปรับแก้ไข/เปลี่ยนรายละเอียดบรีฟให้อยู่ในขอบเขตที่เราทำได้โดยไม่ต้องยกเลิกคิว— แนวทางการส่งรายละเอียดบรีฟ
❖ เป็นเพียงแนวทางคร่าว ๆ ให้รีเช็คเท่านั้น ไม่บังคับว่าต้องมีข้อมูลครบ เทมเพลตบรีฟ
❖ แนะนำให้รวบรวมข้อมูล (ข้อความ, รูปภาพ, ไฟล์ และ Link อื่นๆ) ไว้ในพื้นที่เดียวกันจะทำให้เราสะดวกทำงานมากขึ้นค่ะ แนะนำมากสุดจะเป็น Google Doc/Slide, Google Drive, PDF หรือเขียนรวบมาในไฟล์ภาพ(.jpg/ .png)อันเดียวก็โอเค— การชำระเงิน / ข้อกำหนดในการคืนเงิน / ยกเลิกงาน
❖ โอนเต็มจำนวนหลังภาพร่างเส้น/ดราฟต์สีผ่านการตรวจ หรือเลือกโอนมัดจำ 50% ของราคางานแทนหากยอดเกิน 1,500 THB ชำระเงินภายใน 3-7 วันหลังสรุปราคา ยอดคงค้างที่เหลือจะชำระอีกครั้งเมื่องานเสร็จ
❖ ชำระเงินผ่านธนาคาร (ไทยพาณิชย์ | กสิกร)
❖ หลังการชำระเงินและยืนยันภาพร่างเรียบร้อย จะไม่สามารถขอคืนเงินหรือยกเลิกงานได้ (จะมีการคืนเงินให้ในกรณีที่เราไม่สะดวกทำงานต่อและขอยกเลิกงานเอง)— การจัดเวลาทำงานและการขอแก้ไข
❖ ระยะเวลาทำงานต่อภาพหนึ่งอาจอยู่ที่ 7-60 วัน (ตามประเภทงานและรายละเอียด) ไม่รับงานเร่งที่ต่ำกว่า 2 อาทิตย์ กำหนดเดดไลน์ระยะไกลได้เพื่อเพิ่มความสะดวกให้เราจัดการเวลาทำงาน หากมีเหตุที่ทำให้งานล่าช้ากว่าเดดไลน์ เราจะแจ้งให้ทราบทันทีค่ะ
❖ แก้งานได้ในขั้นร่างเส้นและดราฟต์สีทั้งหมด 3 ครั้ง นับเฉพาะการแก้ดีเทลจุดใหญ่ๆ (เช่น เปลี่ยนท่าทาง เพิ่มองค์ประกอบที่นอกเหนือจากบรีฟ หรือการรื้อคอมโพสจัดองค์ประกอบใหม่) หากเป็นจุดที่เราพลาดหรือตกหล่นไปเองจะไม่นับ การแก้ไขหลังจากนั้นจะขอคิดเพิ่มเริ่มต้นที่จุดละ 50 THB+— เกี่ยวกับไฟล์และการส่งงานสำเร็จ
❖ ขนาดของงานจะปรับเปลี่ยนตามประเภทงานและความเหมาะสมค่ะ ผู้ว่าจ้างสามารถแจ้งแนวหน้ากระดาษ (แนวตั้ง | แนวนอน) หรือแจ้งจุดประสงค์ของการใช้ชิ้นงาน (e.g. ตั้งหน้าจอคอมพิวเตอร์/ไอแพด, พิมพ์โปสการ์ดขนาด 4x6") ก่อนเริ่มงานได้ โดยปกติเราจะใช้ขนาดหน้ากระดาษไม่ต่ำกว่า 1200*1200 px 300 dpi โหมดสี RGB
❖ ไฟล์งานหลัก ๆ ที่จะได้รับจะอยู่ในรูปแบบ .jpg และ .png / หรือ .psd แบบ merged layer ในบางกรณี
❖ ส่งงานผ่าน Google Drive หรือ Email

Terms Of Service & Agreement
Agreement
— General Terms
❖ The client must carefully read the entire Terms and Conditions. When the work has started, I will consider that the client has read and agreed to the ToS
❖ All of the finished commissioned artwork will be displayed on social media platforms (e.g., Twitter, Facebook) as my portfolio or for promotional purposes with a watermark. The client still retains the right to specify the extent of distribution (NDA required will incur some fees)
❖ The client does not always necessary to provide credit to the artist, but is not permitted to claim the artwork as their own. The credit can be given under the name 'AspirinMarble' or linked to my social accounts
❖ Commercial usage must be informed before the start of work. The total price for commercial usage will be double(x2) the original price (personal use price)
—NOTE: Commercial usage including using artwork to make products, monetization, or reproducing them for profit. For example, selling images, novel covers, postcards, merchandise (such as keychains and standees), artwork for advertising, and Vtuber-related artwork. If the client is unsure of the scope of use, please inquire with me for more information via Facebook, Twitter, or Email
❖ The usage of artwork for any kind of NFT or AI Generator purpose is prohibited— Intellectual Property Rights
❖ The artist retains full copyright and intellectual property rights of the artwork. including recording Timelapses and publishing WIP of the artwork without prior notice unless otherwise agreed
❖ After completing and delivering the file, the client has the right to modify the work only by adjusting the color tone, cropping, adjusting the resolution, rearrange layout, reproducing and duplicating the artwork
❖ Some kind of editing, such as drawing over, motion rigging, or using tools to adjust the shape of the original artwork. The client must ask for permission from the artist first to consider the scope. Anyway, Tracing art is prohibited
❖ In case a separate transparent character file is provided, the client has the right to add the background and props by themselves without affecting the original artwork
❖ Other conditions can be discussed as agreed upon
Working Process
— Reservation
❖ The client makes a reservation via the platform according to the specified schedule
❖ Each queue can order a maximum of 2 artworks
❖ The queue will be sorted according to the order in which the commission detail is submitted (not depending on the reservation order). The next queue starts once the previous queue is completed
❖ The commission's details should be sent within 7 days after the confirmation of the reservation
❖ I reserve the right to decline the request with complicated details or content that exceeds my drawing capabilities. Nevertheless, the client can modify or change the details of the request without canceling the reservation— Requirement Guideline
❖ (Coming soon...)— Payment / Cancelation / Refund
❖ The full payment must be made within 3-7 days after the draft has been approved
❖ Payment is accepted via PayPal, Vgen Payment or Buy Me a Coffee, in USD currency
❖ Refunds or cancellations are not available after the draft has been confirmed. In case the artist cancels a commissioned artwork, a refund will be issued— Working Timeframe / Revisions
❖ Each commission work would take 7-60 days to complete (the time will count after the draft is made)
❖ However, the client can set a deadline that is not urgent (at least more than 2 weeks). If I have any emergency reasons that cause work to be delayed, I will inform the client immediately
❖ The client can make up to 3 revisions in the rough sketch and color sketch process. Only major detail revisions are counted (such as changing posture, adding more elements or props that weren't in the initial requirements). Extra revision(s) after the draft is done will incur additional fees— Files Setting / Deliverables
❖ The artwork file size will be adjusted based on its suitability. Generally, the resolution is set at not lower than 1200*1200 px 300 dpi with RGB mode. If the client has a specific size requirement for the artwork, please inform me in advance
❖ Completed artwork will be delivered in .jpg/.png format and/or a merged PSD file as an optional via Google Drive, Vgen built-in system or Email
